Día 18 – ¿Por qué NO exportar EXW?

Creo que todo exportador se sentirá identificado cuando diga que lo más seguro y menos arriesgado para nuestro negocio es vender EXW (es decir, hacer que el comprador se encargue de todo el proceso logístico).

¡PUES NO!

Antes de nada me gustaría aclarar que yo soy una mera usuaria de Incoterms, no una experta en el área. Mi único objetivo aquí es el de tratar de trasladar las interesantes ideas que expone el Sr Vilá en su video. Así que, si existe alguna errata, agradeceré inmensamente que me la corrijáis.
¿Qué son los incoterms?
Como sabréis, los incoterms son esas cosas que aparecen en folletos, manuales de comercio exterior, etc., que mil veces nos han explicado, pero nunca hemos entendido, y que todo el mundo menciona sin saber muy bien por qué.
Reconozco que yo soy una de esas personas que los utiliza porque lo tiene hacer… y es que admito que aún me cuesta horrores entender cuáles son exactamente las particularidades de cada uno. Por ejemplo, quién costea los portes, quién corre con los riesgos, cuándo se traspasa lapropiedad de la mercancía, ¿marítimo, polivalente?….
Gracias a esta maravillosa videosesión que encontré mientras navegaba por la también interesantísima web del programa Exportar para Crecer creada por el Banco Sabadell (y que os recomiendo encarecidamente que visitéis), he logrado comenzar a entender algo más… ;)
Por ello, y aunque haya iniciado el video en el minuto en el que comienza a explicar los inconvenientes de la venta EXW, os recomiendo que lo veáis al completo.
¿Qué supone exportar EXW  (Ex-Works)?
Antes de comenzar es importante explicar que realizar un envío internacional usando el incoterm EXW significa que nuestra única responsabilidad como vendedor es la de fabricar la mercancía y guardarla en nuestros almacenes hasta que la recoja el comprador.
De esta manera, es el importador/comprador el encargado de realizar todo el proceso detransporte y trámites para la importación, esto es:
– Formalidades aduaneras de exportación y de importación: encontrar a agentes de aduanas tanto en la aduana de origen -en España -, como en la de destino para que se encarguen de realizar el despacho de la mercancía, es decir, presentar toda la documentación que le requieran y abonar los aranceles e impuestos exigidos con el fin de que ésta pueda abandonar España y entrar en el país de destino.
– Transporte principal (barco, avión…): en la mayoría de los casos, y dado que el transporte por carreteras está limitado a ciertos territorios (por motivos geográficos -obviamente-), el comprador deberá recurrir al transporte por barco o avión. Este transporte pasa a considerarse el principal y se complementa con el transporte interior, que suele realizarse por carretera.
– Transporte interior en origen y destino: por ejemplo, si estamos en Madrid, para hacer llegar la mercancía al transporte principal, vamos a necesitar que el comprador nos envíe un camión (transporte por carretera) para recoger la mercancía y transportarla por territorio español hasta el puerto o aeropuerto. Lo mismo en el país de destino desde el puerto o aeropuerto, si procede.
– Seguros: permiten la cobertura de los riesgos del transporte. Se suele calcular en base al valor de la mercancía y los kilos reales brutos. Todo un mundo, así que si queréis saber más, mirad aquí.

El mito de exportar EXW
Como veréis, realizar un envío internacional conlleva tantas tareas, que el hecho de que sea el importador o comprador el que se encargue de ellas, ¡supone todo un alivio!
Sin embargo, lo que parece un alivio para nosotros como vendedores, puede significar una gran desventaja en todos aquellos envíos fuera del territorio nacional (España y la UE)…
Y es que ¡OJO! realizar un envío internacional no consiste en ocuparse únicamente de todas las gestiones relacionadas con la organización del mismo (es decir, contratar los transportes y papeleo). Por el contrario, entra en juego lo que realmente hace que un envío internacional sea complejo:
La propiedad de la mercancía, el riesgo y los costes.
Tal y como aparece en los dibujos anteriores, en la venta EXW, el riesgo y los costes del vendedor terminan en el momento de la “entrega de la mercancía de los almacenes del vendedor.
Sin embargo, tal y como nos muestra el Sr Vilà en su vídeo, ésto no es tan sencillo…
Desventajas de exportar EXW
– Riesgo:
Dado que la “entrega” se considera realizada en el momento en que yo le digo al comprador que tengo la mercancía preparada, la propiedad de la mercancía pasa a ser del comprador a pesar de que la mercancía la tenga yo en mi poder…
Hasta aquí todo parece sencillo.
Pero claro, entre los días que pueden pasar entre que yo he informado de la “entrega” al comprador y éste efectúa la recogida… ¿qué pasa si ocurre un accidente? Por ejemplola mercancía se incendia, se inunda…
¿Quién asume el coste?
Acudiríamos al seguro. Pero para nuestro seguro la situación es compleja. Cuando le diga: “tengo una mercancía en mi almacén que en realidad no es mía”… mi seguro se reirá probablemente.
Quedamos entonces a expensas de lo que diga el seguro del comprador… Pero nos ponemos en la situación similar: Cuando el comprador en Australia le diga a su seguro “se me ha quemado una mercancía que tenía en un almacén de Madrid, a nosecuantosmil km de aquí y de la cual yo no había informado…”, pues se reirá también seguramente.
De manera que, vemos que vender EXW implica contar con el riesgo de hacer frente a los costes si a  la mercancía que ocurre algún incidente entre el momento en que he informado de la “entrega” y el comprador la recoge.
– Deducirnos el IVA de exportación: 
Con el fin de poder demostrar que hemos realizado una exportación y así justificar la deducción del IVA de esa factura de venta, debemos presentar un documento llamado DUA (Documento Único Administrativo) – aquí para más información –
Dado que va a ser el comprador quien realice las formalidades en la aduana de origen (España), será él quien reciba ese documento, no nosotros.
Si este documento lo recibe el comprador, puedo pedírselo… pero es poco práctico y arriesgado.
Digamos que vender EXW nos hace perder “poder” sobre cierta parte esencial del proceso de entrega de la mercancía, que es la de la obtención del documento DUA requerido por nuestra legislación.
– Falta de profesionalidad:
En la grandísima mayoría de los casos, el comprador va a solicitar que el envío se realice en términos FOB, CIF… es decir, van a solicitar la implicación del exportador en el proceso logístico.
Restringirse a la venta EXW significa una pérdida de competitividad notable frente a nuestros competidores, y da una terrible impresión de falta de apertura y flexibilidad. En definitiva, denota una gran falta de experiencia exportadora.
¿Cuál es la solución?
Como bien indica el Sr Vilá, lo más conveniente será pasar del uso del EXW al FCA, por ejemplo.
De esta manera, nosotros recuperaremos control sobre las formalidades en aduana de origen(tendremos acceso directo al DUA nosotros mismos).
Además, como el FCA conlleva que la “entrega” de la mercancía se realizará cuando físicamenteentreguemos la mercancía al transportista, estamos ayudando a identificar claramente de quién es en cada momento la propiedad de la mercancía, es decir, cuándo termina mi responsabilidad y cuándo empieza la suya. Esto le gustará a nuestro seguro.
Pensémoslo bien: exportar en otros incoterms tampoco es tan complicado. Encargarse del proceso de un envío internacional puede resultar tan “sencillo” como realizar un envío nacional.. siempre que contemos con un buen transitario, claro…

First of all I would like to clarify that I am merely a user of Incoterms, not an expert in the area. My only goal here is to try to move the interesting ideas that exposes Mr. Vilá in your video. So if there is any mistake, I'd appreciate immensely the corrijáis.

What are Incoterms?

As you know, the Incoterms are those things that appear in brochures, manuals trade, etc., that have told us a thousand times, but we never understood, and everyone mentioned without really knowing why.

I acknowledge that I am one of those people who uses them because they have done ... and I admit that I still can not understand what horrors are exactly the characteristics of each. For example, who pays the freight, who bears the risk, when ownership of the goods is transferred, maritime, multi-purpose? ....

Thanks to this wonderful videosesión I found while browsing the website also interesting Export to Grow program created by Banco Sabadell (which I highly recommend you visit), I managed to begin to understand something more ...;)

Therefore, and although it has started the minute video which begins to explain the drawbacks of the EXW, I recommend that you see him in full.

What does export EXW (Ex-Works)?

Before beginning it is important to explain that during international shipping using incoterm EXW it means that our sole responsibility as a seller is to manufacture and store the goods in our warehouses until you collect the buyer.

Thus, it is the importer / buyer responsible for the whole process of transportation and import procedures, namely:

- Customs formalities for export and import: customs agents find both at the office of origin -in Spain - as in the target to be in charge of carrying out the clearance of goods, ie, submit all documentation requiring him to pay the fees and charges required in order to enable it to leave Spain and enter the country of destination.

- Main Transport (ship, plane ...): in most cases, and as road transport is limited to certain territories (for geographical reasons, obviously), the buyer must resort to transport by ship or plane. This transport is then regarded the principal and is complemented by internal transport, usually by road.

- Internal Transport at origin and destination: for example, if we are in Madrid, to deliver the goods to the main transport, we will need the buyer send us a truck (road transport) to collect the goods and transport for Spanish territory until the port or airport. The same in the destination country from the port or airport, if applicable.

The myth of export EXW

As you see, make an international shipment involves many tasks, the fact that it is the importer or buyer to take care of them, implies a relief!

However, it seems a relief for us as sellers, can make a big disadvantage in all those shipments outside the country (Spain and the EU) ...

And is that EYE! during international shipping is not only deal with all the formalities related to its organization (ie, hire transport and paperwork). By contrast, comes into play what really makes international shipping is complex:

The ownership of the goods, the risk and costs.

As the risk appears in the previous drawings, sell EXW, and end up selling costs at the time of the "delivery" of the goods from the warehouses of the seller.

However, as Mr Vilà shows in his video, this is not so simple ...

Disadvantages of export EXW

- Risk:

Since the "delivery" is considered made at the time that I tell the buyer that the goods have prepared, ownership of the goods becomes the buyer even though the goods I have it in my power ...

So far everything seems simple.

But of course, between the days to pass between I reported the "delivery" to the buyer and this makes the collection ... what if an accident happens? For example, the merchandise is on fire, it floods ...

Who bears the cost?

We would go to insurance. But our secure the situation is complex. When you say, "I have in my store goods that is actually not mine" ... my insurance will probably laugh.

Then we are at the expense of what the insurance buyer say ... But we put ourselves in the similar situation: When the buyer in Australia tell your insurance "has burned me a good that was in a warehouse in Madrid, nosecuantosmil km here and which I had not informed ... "because surely will laugh too.

So, we see that sell EXW risk means having to cope with the costs if the goods an incident from when I reported the "delivery" and the buyer picks occurs.

- Deducirnos export VAT:

In order to demonstrate that we have made and to justify an export deduct VAT that bill of sale, must present a document called SAD (Single Administrative Document) - here for more information -

Since it will be the buyer who perform the formalities at the office of origin (Spain), he who receives the document will, not us.

If this document is received by the buyer, I can ask ... but is impractical and risky.

Say you sell EXW we lose "power" over some essential part of the delivery of the goods, which is to obtain the document DUA required by our legislation.

- Lack of professionalism:

In the overwhelming majority of cases, the buyer will ask that the shipment is made on terms FOB, CIF ... that is going to request the involvement of the exporter in the logistics process.

Restricted sale EXW means a significant loss of competitiveness against our competitors and gives a terrible impression of lack of openness and flexibility. In short, it denotes a lack of export experience.

What is the solution?

As indicated by Mr. Vila, it will spend more convenient use of the FCA EXW, for example.

In this way, we recover control over customs formalities of origin (DUA will have direct access to ourselves).

Moreover, as the FCA means that the "delivery" of the goods is performed when physically deliver the goods to the carrier, we are helping to clearly identify who is at all times the property of the goods, that is, when my responsibility ends and when begins his. This will appeal to our insurance.

Let us think well: in other incoterms export is not so complicated. Handle the process of an international shipment may be as "simple" as to conduct a national shipping .. provided we have a good freight forwarder, of course ...

Single Administrative Document (SAD):

Particular requirements

document_worldEs una de las primeras preguntas que suele realizar el pequeño empresario cuando acude al consultor de comercio exterior. El comercio mundial está ya muy regulado y los distintos trámites para poder vender y comprar productos en el extranjero están muy normalizados. Con hacer una gestión en la Consejería de Economía y Hacienda de su comunidad y en la Cámara de Comercio cualquier emprendedor puede informarse de los distintos formularios y documentos necesarios para materializar la venta de esa partida que tendría que salir al mercado en lugar de acumularse en el almacén.


Documentos tipo
No todos los países siguen el mismo protocolo para permitir la entrada de alimentos a través de sus fronteras. Conviene pues conocer de antemano el o los mercados exteriores hacia los que se quiere dirigir nuestra producción para no andar de ventanilla en ventanilla. No obstante, el pequeño empresario que inicia el proceso de internacionalización de su Pyme terminará familiarizándose con unos cuantos documentos, esenciales en la entrega de la mercancía:
Documento Único Administrativo (DUA):
Es un documento que se exige siempre en la aduana de salida. El DUA es simplemente una declaración documentada de las características de la operación. Aunque lo puede presentar directamente el exportador, es frecuente que lo gestione un agente de aduanas.
Importación Temporal. Cuaderno ATA:
En los países signatarios del Convenio sobre Admisión Temporal (Convenio de Estambul) es necesario el Cuaderno ATA. (Admission Temporaire – Temporary Admission), para el comercio de diversas mercancías. Es una especie de pasaporte de mercancías que permite al emprendedor ahorrarse trámites y depósitos de garantías o cauciones en las aduanas de los países firmantes del Convenio. Cada país no obstante determina qué productos se pueden beneficiar de este documento que se puede obtener en la Cámara de Comercio correspondiente.
Certificado de Origen:
Es con el sanitario y el fitosanitario (para alimentos, principalmente producto cárnicos) un documento que tendrá que tener para casi todos los países de fuera de la Unión Europea a los que quiera dirigir su mercancía. El certificado de origen lo puede tramitar en su cámara de comercio. Los otros en la delegaciones de sanidad del Gobierno. Puede obtener más información en Subdirección General de Acuerdos Sanitarios y Control en Frontera.
Licencia de exportación:
Es necesaria para exportar productos que tienen limitaciones en el país de origen, tanto cualitativas como cuantitativas (armas, materiales tóxicos…). Se presenta en el puerto de embarque y se detallan términos comerciales y financieros declarados por los titulares.
Requisitos particulares
Aunque el pequeño exportador deberá acompañar estos documentos en casi todas sus exportaciones, tendrá que cumplir también ciertos requisitos que piden de forma particular en cada uno de los mercados. Es importante tener en cuenta que debido a las particularidades que suelen tener las diferentes aduanas del mundo para controlar los productos que acceden al mercado interno de sus respectivos países (incluso las eventuales diferencias de criterio entre los funcionarios de un mismo país), es recomendable siempre contrastar la información que obtengamos de los funcionarios españoles y asesores de exportación con el comprador antes de realizar cualquier envío. Destinos como China o Estados Unidos son un ejemplo de peculiaridad de los que a continuación detallamos dos ejemplos:
Factura Comercial:
Si está pensando exportar a China, tendrá que emitir una factura comercial redactada en inglés y en chino en la que se detallan los datos de fecha, lugar, vendedor, destinatario, precio, detalles de coste de los fletes, seguro de exportación, INCOTERM pactado… No hay existe un formulario específico por lo que es recomendable asesorarse bien antes de cumplimentarlo.
“Importer Security Filing” (ISF):
Si quiere exportar a Estados Unidos por barco, deberá presentar este documento a en la aduana de entrada EE.UU. 24 horas antes de la descarga de la mercancía. La norma es efectiva desde el pasado 26 de enero de 2010. La presentación de este documento se realiza de forma telemática y es frecuente que se presente por el agente de aduanas.

Un día, de repente, comenzarás a ganar batallas

Tarde o temprano todas las piezas acaban encajando. Hasta entonces, ríete de la confusión, vive el momento y entiende que todo sucede por algún motivo.
Sé fuerte, resiste y trabaja por pelear sin miedo porque la dificultad de algo aumenta en la medida en la que dejas de intentarlo y la vida es lo que ocurre hoy, no mañana.
Se suele decir que lo bueno de tocar fondo es que ya no podemos hundirnos más, que cogemos impulso y que salimos a flote. La clave está en mirar insistentemente hacia arriba, pisar firme y salir.

Aceptar que nuestra vida está en continuo movimiento es la manera de impulsarnos y salir a flote para ver el sol. Nos hemos roto y nos han quebrado, pero hemos sido capaces se soldar esas heridas, de perdonar y de perdonarnos.
